Kroger's pharmacy serves customers all over the country. Whether your prescription costs $4 or $400, if you're a customer who did business there, a recent class-action lawsuit may involve you.
The total payout of $17 million must be divided among all claimants, so it's not likely to make anyone rich. But you can still benefit if you know how it works and what to do to put more cash in your pocket.

What the Kroger lawsuit alleges
The lawsuit states that Kroger's "usual and customary" handling of prices for certain generic prescriptions caused some insured customers to pay more than they should have. Usual and customary pricing is what a pharmacy reports as its normal cash price for a drug, and it affects what an insurer or benefit manager calculates for the customer's portion of the cost.
Plaintiffs say Kroger didn't account for lower prices offered through its Kroger Savings Club when reporting these prices, so customers had higher insurance-related out-of-pocket costs than necessary.
Like most class-action lawsuits, the case doesn't claim criminal acts, and Kroger denies the allegations altogether. The store also maintains that Savings Club prices aren't usual and customary because customers have to enroll and pay an annual membership fee to enjoy the benefits.
Do you qualify for payment?
You may have shopped at Kroger, but it doesn't mean you automatically become part of the settlement class. To qualify, you must have:
- Paid all or part of the cost of one or more prescriptions at a Kroger-owned or operated pharmacy
- Used insurance when you paid
- Made the qualifying purchase between December 9, 2018 and August 23, 2026
The settlement covers people who reside in the United States or its territories. Also, this wide range of dates could cover a lot of people, but only those who paid at least part of the cost themselves while insured qualify. You may have already received a notice letting you know you qualify, but those without a notice may still be eligible.
How $17 million gets paid out
The large expected payout isn't for one person and must be shared for the entire class. It's calculated on a pro-rata basis, so each claimant's amount will be based on the qualifying out-of-pocket amount they paid.
The payout must also pay for any court-approved attorney's fees, litigation costs, and administrative expenses. So that amount could drop before it reaches customers' hands. This is typical for any class-action lawsuit and why the big dollar amount isn't the whole story.

How to submit a claim
Filing your claim takes just a few minutes, but it's important to follow each step carefully.
- Go to the official settlement website: KrogerSavingsClubSettlement.com
- Use the official Claim ID from any notice you received (if applicable)
- Report your actual or good-faith estimate of your out-of-pocket spending on qualifying insured prescriptions during the covered time period.
- If your expenses were $8,000 or more, you must provide additional documentation. Lower claims may still require documentation, but not at the time. Useful records could include receipts, insurer explanation-of-benefits (EOBs), pharmacy account history, or online order history.
- When the settlement claim is processed, you'll receive further instructions on receiving your payout, including how to choose a paper check, ACH transfer, virtual prepaid card, PayPal, Venmo, or Zelle.
Deadlines to watch
If for any reason you think you qualify but want to opt out, you must do so by October 22, 2026. Someone may do this if they want to preserve their right to take their own legal action.
Claims must be filed by December 21, 2026, but earlier is better—especially if you choose to mail the form instead of uploading it to the official website. Postal mail times vary, and the online option gives you immediate confirmation of your submission.
Final approval by the court will be considered at the scheduled fairness hearing on January 11, 2027.
What to do after you file
Payments only happen after the settlement becomes effective and are expected within 150 days of the effective date. Legal proceedings can take time, however, and updates can be found on the official settlement website.
In the meantime, avoid giving out any personal information, including banking details, in response to unsolicited calls, texts, emails, or social media messages without first consulting the website. Do not pay anyone to submit or process a claim. This is the best way to avoid scams, which can center around recent, high-profile class-action lawsuits.
