A new Circle K class-action settlement might eliminate some money stress for eligible claimants. If your personal data was exposed during the 2024 Circle K data breach, you might be eligible to receive a payout from the settlement, but only if you file a claim by the approaching deadline.

The Circle-K class-action lawsuit
The class-action lawsuit against Gas Express LLC, which operates Circle K, alleges that Gas Express LLC didn't appropriately safeguard sensitive personal information. During a May 2024 cyberattack on the business' systems, files containing customers' personal information were exposed. The court filings indicate that the exposed information may have included names, Social Security numbers, and other data that could potentially lead to data theft.
Circle K denied wrongdoing but reached a settlement to avoid ongoing litigation.
Who may be eligible to file a claim
The settlement class includes individuals currently living in the United States. These individuals were sent a notice by Gas Express LLC/Circle K indicating that their data was impacted by the data breach. The settlement class excludes people who are directors, officers, and agents of Gas Express LLC/Circle K, as well as governmental entities.

Documented loss cash payments
Qualifying individuals may file a claim for one or two cash payment options. If you experienced documented out-of-pocket losses resulting from the data breach, you may file a claim for up to $2,000. The loss must have occurred between May 20, 2024, and September 3, 2026, and you must provide proof, like receipts, to document out-of-pocket expenses like losses because of identity theft, fees for credit reports or credit monitoring, and the cost to replace your IDs.
If you have already received reimbursement for the expenses from a third-party, you're no longer eligible to file a claim for those expenses.
Documented loss cash payments are capped at $45,000, so if the total number of claims reaches $45,000, no additional claims can be accepted.

Alternate cash payments
If you don't have a documented loss, you may choose to file for an alternate one-time cash payment of $50. The number of alternate cash payment claims is capped at 700 claims. Once 700 valid claims are received, no additional claims can be accepted. This claim option doesn't require any proof of loss or documentation.
Deadlines to file a claim
You may file a claim using the online claim form at GasExpressDataSettlement.com. Alternatively, you may download a printable claim form and mail in your claim.
Online form submissions must be completed by September 3, 2026. Mailed forms with supporting documentation must be postmarked by September 3, 2026.
Since there is a cap on the total amount of the documented loss cash payment option and the number of alternate cash payment claims, it's a good idea to submit your claim soon.
Credit monitoring for settlement class members
The settlement includes two years of CyEx Financial Shield Complete credit monitoring, which comes with $1 million of financial fraud insurance. The service includes monitoring for fraud or identity theft, unauthorized financial transactions, and personal information associated with high-risk transactions. Fraud resolution agents are available to help fix any problems that might occur.
All settlement class action members may claim the credit monitoring service.
How to opt out of the settlement
If you don't file a claim, you are still a part of the settlement, and you'll sacrifice your rights to sue Circle K on your own. If you want to retain your rights to your own lawsuit, you must opt out of the settlement. You must mail a request for exclusion to the Settlement Administrator postmarked by September 3.
When to expect a payment
The Court needs to issue a final approval for the settlement, which is scheduled for September 18, 2026. If anyone appeals, those appeals need to be resolved before payments may be issued. As a result, there is currently no scheduled date for payments to be issued, but check the official settlement website for updates.
Bottom line
Scams around class-action settlements are common, so be sure to refer to the official settlement website for guidance. The settlement still needs final Court approval before payments may go out, but in the meantime, be sure to file your claim early to maximize your chances of receiving a payment before the caps are reached.
